Hi Homes Rentals and Property Management


1. General Conditions

This Booking Agreement is made in Spain between:

Hi Homes Rentals and Property Management, CIF B23976467, registered in Spain, with registered office at:

Calle Badajoz de Jarales, Local 26, 29649 Calahonda, Málaga, Spain.

Office hours are Monday to Friday from 09:00 to 17:00. The office is closed on Saturdays and Sundays.

(hereinafter referred to as “Hi Homes”),

and

The person making the booking and all members of their party (hereinafter referred to as the “Client”).

By confirming a booking via the website or any other booking channel, the Client agrees to these Terms and Conditions.


2. Basis of Agreement

Hi Homes promotes and manages holiday rental properties on behalf of property owners in Spain. All properties are managed under our rental and property management services.

This Agreement governs the rental of the selected property for the agreed holiday period.


3. Property Descriptions

Hi Homes takes all reasonable precautions to ensure that property descriptions and prices shown on the website are accurate. However, errors may occasionally occur.

Hi Homes reserves the right to amend descriptions or prices if necessary. In such cases, the Client will be notified and given the option to accept the changes or cancel the booking with a full refund.


4. Prices

All prices are stated in Euros (€). All payments must be made in Euros.

The rental price includes:

  • Occupation of the selected property for the booked period

  • Standard pre-arrival and post-departure cleaning

  • One set of clean bed linen and bathroom towels per guest (excluding beach towels)

  • Standard utility charges (electricity, gas, and water)

The rental price does not include:

  • Flights

  • Transport

  • Travel insurance

  • Emergency call-out charges

  • Additional holiday services

Additional services may be available upon request, subject to availability and additional charges where applicable.


5. Booking Procedure

Full payment (100% of the accommodation price) is required at the time of booking.

A refundable security deposit is required for all bookings and must also be paid in full at the time of booking.

A booking is only confirmed once payment has been received in cleared funds.


6. Security Deposit

A refundable security deposit is required for all properties.

The security deposit is held as security against:

  • Damage to the property or its contents

  • Missing items

  • Excessive cleaning

  • Breach of occupancy limits

  • Noise disturbances or community fines

  • Lost keys or access devices

  • Any breach of these Terms

The deposit will be refunded within 10 days after check-out, provided no damages, losses, breaches, or missing items are identified.

If costs exceed the deposit amount, the Client remains liable for the balance.


7. Guest Registration and Identification

All guests (including adults and children) must complete the legally required guest registration prior to arrival.

Personal information will be submitted to Spanish authorities in compliance with legal obligations.

Failure to complete registration may result in denied access.


8. Arrival and Departure

Check-in: From 16:00
Check-out: By 10:00

The property must be left in reasonable condition. Damage or breaches may result in deductions from the security deposit.


9. Cancellations and Changes

  • 50% of the total accommodation price is non-refundable in all cases.

  • Cancellations within 45 days of check-in are 100% non-refundable.

Security deposits are refundable upon cancellation where applicable.

Force majeure may allow date postponement at Hi Homes’ discretion, subject to availability.


10. Changes or Unavailability

If the property becomes unavailable due to unforeseen circumstances, Hi Homes may cancel the booking and issue a full refund.

Alternative accommodation may be offered but is not guaranteed.

The refund shall constitute full and final settlement.


11. Keys and Access

Keys are generally handed over at the property by a representative of Hi Homes.

In some cases, access may be provided via secure key box.

Lost keys or access devices may result in charges.

Hi Homes may access the property with reasonable notice for maintenance or emergencies.


12. Occupancy

The number of occupants must not exceed the number confirmed in the booking.

Only listed guests may stay overnight unless prior written approval is granted.

Breaches may result in charges, deposit deductions, or termination of stay depending on severity.


13. Parties, Events and Conduct

The property is for residential holiday use only.

Parties, events, celebrations, or large gatherings are strictly prohibited.

Guests must respect neighbours and comply with community rules.

Quiet hours are from 22:00 to 08:00.

Serious disturbances may result in termination of the stay and/or deductions from the security deposit.


14. Property Use and House Rules

Guests must maintain the property in good condition.

Smoking is prohibited inside the property.

Rubbish must be disposed of properly in the outside containers provided on the street.

 
 

Parking is only permitted in designated areas, whether private, secure, or on-street where applicable, and any fines incurred are the responsibility of the Client.


15. Complaints

Every effort is made to ensure that guests have an enjoyable stay. In the unlikely event of a problem with the property, the Client must notify Hi Homes as soon as possible during the stay so that the issue can be addressed.

If the matter is not resolved, the Client must submit any formal complaint in writing within 28 days of departure.

Compensation, where applicable, shall not exceed the total accommodation rental amount paid.


16. Liability

Hi Homes’ maximum liability for any loss or damage arising in connection with the booking or stay shall be strictly limited to the total accommodation rental amount paid by the Client.

Hi Homes shall not be liable for:

  • Indirect, consequential, or incidental losses, including travel costs or alternative accommodation;

  • Closure of communal facilities managed by third parties;

  • Utility or internet interruptions where reasonable efforts are made to resolve issues;

  • External noise or disturbances;

  • Theft or damage to guest belongings;

  • Accidents, injuries, illness, or death except where caused by proven negligence of Hi Homes;

  • Force majeure events beyond reasonable control.

The Client is responsible for the conduct of their party. Any fines, penalties, or claims arising from their actions are the Client’s responsibility.

Nothing in these Terms excludes liability where such exclusion is not permitted by law.


17. Insurance

Guests are strongly advised to obtain comprehensive travel insurance.


18. Lost Property

Items left behind will be stored for up to three months.

Return costs must be paid in advance.


19. Disputes

Spanish law applies. Jurisdiction: Courts of Málaga, Spain.


20. Acceptance of Terms

By completing a booking, the Client confirms acceptance of these Terms.


21. Data Protection

Hi Homes processes personal data in accordance with GDPR and Spanish data protection law.

Data is used for booking administration, payment processing, communication, and mandatory guest registration.

Data may be shared with authorised service providers for operational purposes.

Personal data will not be sold.
